1. Agreement to Terms

Welcome to UnrealSelf! These Terms of Service (“Terms”) govern your access to and use of the UnrealSelf mobile application, website, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use our Services. We reserve the right to update these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.

2. Eligibility

You must meet the following requirements to use UnrealSelf:

• Be at least 13 years old (or 16 in the European Union)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Services under applicable law
• Not have been previously banned from using our Services

By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To use certain features of our Services, you must create an account. You may register using:

• Email and password
• Google OAuth
• Apple Sign-In

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and current

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, illegal activity, or any other reason at our sole discretion.

4. Description of Services

UnrealSelf provides AI-powered luxury lifestyle photo generation services. Our platform allows you to:

• Upload photos of yourself
• Generate luxury lifestyle transformations using artificial intelligence
• Choose from various scenes (private jets, yachts, villas, red carpet events, etc.)
• Download your creations (watermarked on free tier)
• Share your creations to social media platforms
• Remove watermarks and access high-resolution versions (paid features)

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.

5. Subscription Plans and Payments

5.1 Free Tier

The free tier includes:

• Limited number of photo generations per month
• Watermarked images
• Standard resolution output
• Basic scene selection

5.2 Pro Subscription

The Pro subscription includes:

• Unlimited photo generations
• No watermarks on generated images
• High-resolution downloads (4096px)
• Priority processing
• Access to all premium scenes
• Early access to new features

5.3 One-Time Purchases

You may also purchase:

• Individual watermark removal for specific images
• High-resolution downloads for specific images
• Additional generation credits

5.4 Payment Processing

• All payments are processed securely through Stripe
• We do not store your credit card information
• Prices are in USD unless otherwise stated
• All sales are final unless otherwise required by law

5.5 Billing and Renewal

• Subscriptions automatically renew unless cancelled
• You will be charged at the beginning of each billing cycle
• You can cancel your subscription at any time in Settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial billing periods

5.6 Price Changes

We reserve the right to change our pricing at any time. If we increase subscription prices, we will notify you at least 30 days in advance. Continued use of the Services after the price change constitutes acceptance of the new pricing.

6. Refund Policy

6.1 General Policy

All sales are final. We do not offer refunds for subscriptions or one-time purchases except as required by law or in exceptional circumstances at our sole discretion.

6.2 Exceptions

We may consider refunds in the following cases:

• Technical issues preventing service access for extended periods
• Billing errors or duplicate charges
• Unauthorized charges (subject to investigation)

6.3 App Store Purchases

If you purchased your subscription through the Apple App Store or Google Play Store, refunds are handled by those platforms according to their refund policies. We cannot process refunds for app store purchases.

7. User Content and Conduct

7.1 Content Ownership

You retain ownership of the photos you upload to UnrealSelf. By uploading content, you grant us:

• A license to process your photos using AI to generate transformations
• The right to store your photos and generated images on our servers
• Permission to display your generated images within your account

7.2 Generated Images

• You own the generated images created from your photos
• You may use generated images for personal or commercial purposes
• We do not claim ownership of your generated images
• We do not use your photos or generated images for AI model training

7.3 Prohibited Content

You may not upload photos that:

• Depict minors (under 18 years old)
• Contain nudity or sexually explicit content
• Violate any third party's intellectual property rights
• Depict illegal activities or promote violence
• Contain hate speech, harassment, or discriminatory content
• Are of celebrities or public figures without permission
• Violate any applicable laws or regulations

7.4 Content Moderation

We reserve the right to review, monitor, and remove any content that violates these Terms. We may use automated systems and human review to enforce our content policies.

7.5 Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use automated tools to access the Services (bots, scrapers, etc.)
• Reverse engineer or attempt to extract source code
• Resell or redistribute our Services
• Share your account with others

8. Intellectual Property Rights

8.1 Our Property

UnrealSelf and all related logos, designs, text, graphics, software, and other content (excluding user content) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or create derivative works of our Services
• Use our trademarks without written permission
• Remove any copyright or proprietary notices
• Frame or mirror any part of the Services

8.4 Copyright Infringement

9. AI Technology and Limitations

9.1 AI-Generated Content

Our Services use artificial intelligence to generate images. AI-generated content is inherently unpredictable and may not always produce desired results.

9.2 No Guarantees

We do not guarantee:

• Perfect likeness or accuracy in generated images
• Specific results or outcomes
• Suitability for any particular purpose
• Error-free or uninterrupted service

9.3 Processing Time

Image generation typically takes 1-5 minutes. Processing times may vary based on server load and image complexity. Pro subscribers receive priority processing.

9.4 Failed Generations

If an image generation fails, we will attempt to reprocess it automatically. Failed generations do not count toward your monthly limit (free tier) or usage tracking.

Our Services integrate with third-party platforms including:

• Google OAuth (authentication)
• Apple Sign-In (authentication)
• Stripe (payment processing)
• AWS (cloud storage)
• OpenAI (AI processing)
• Instagram, TikTok, Twitter, Facebook (social sharing)

Your use of third-party services is governed by their respective terms and policies. We are not responsible for third-party services or any issues arising from their use.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

13. Termination

13.1 By You

You may terminate your account at any time by deleting it in Settings. Upon termination:

• Your subscription will be cancelled (no refund for remaining period)
• Your account data will be deleted within 90 days
• You will lose access to all stored images

13.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• Your account is involved in illegal activity
• You engage in abusive behavior toward our team or other users
• Your payment fails or you have outstanding balances
• We are required to do so by law

13.3 Effect of Termination

Upon termination, all licenses granted to you under these Terms will immediately terminate. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Dispute Resolution

14.1 Informal Resolution

14.2 Arbitration Agreement

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.
